Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you ("you", "your") and Jolly Web Consulting ("Jolly Web", "we", "us") and govern your use of the Jolly Web Review Generator at review-generator.jollyweb.co (the "Service"). By using the Service you agree to these Terms.

2. What the Service does

The Service generates draft customer-review text from publicly available content on a business website. The free version generates one review at a time from a URL you submit. Paid subscribers get a permanent branded page that generates three fresh reviews on each visit, plus deep links to public review platforms (Google, Facebook, Yelp, Nextdoor) so visitors can copy a review and post it themselves.

The Service does not post reviews on your behalf. It does not impersonate customers. It produces drafts that a real customer chooses, edits if they wish, and submits to a third-party review platform under their own account.

3. Eligibility and accounts

You must be at least 18 years old and authorized to act on behalf of the business whose website you submit. Paid signup is invite-only; codes come from existing customers. You are responsible for keeping the magic-link recovery email address accurate and accessible.

4. Subscription and billing

Paid subscriptions are billed at the price displayed at checkout (currently $50 per month) through Stripe. Subscriptions renew automatically each month until you cancel. You can cancel at any time from the management link emailed to you at signup, which opens the Stripe billing portal.

Cancellation stops future renewals. The Service remains active until the end of the current paid period; we do not pro-rate refunds for partial months.

We may change pricing on at least 30 days' notice by email. Price changes do not apply retroactively to invoices already issued.

5. Referral credits

Every paid subscriber gets a referral code. When a new customer signs up using your code and their subscription becomes active, you receive a credit equal to one month of the current plan price, applied to your next Stripe invoice. Credits are non-cash, non-transferable, and have no value outside the Service. We may modify the referral program with reasonable notice.

6. Acceptable use

You agree not to:

• Submit a business website you are not authorized to represent, or impersonate another person or business.
• Post Service-generated review text to a review platform under a customer's name without that customer's informed consent and authorship.
• Use the Service to create fake reviews, manipulate ratings, or violate any review platform's terms (Google, Facebook, Yelp, and Nextdoor all prohibit reviews not authored by the actual customer).
• Reverse engineer, scrape at scale, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
• Use the Service for any unlawful purpose or in violation of these Terms.

We may suspend or terminate accounts that violate this section without refund.

7. Your responsibility for posted reviews

Reviews posted to Google, Facebook, Yelp, Nextdoor, or any other third party are governed by the rules of that platform. Customers, not the Service, are the authors of any review they choose to post. You are responsible for ensuring your customers understand that the suggested text is a draft they should review, edit, and adopt only if it reflects their honest experience.

8. Intellectual property

The Service's code, design, brand, and content (other than your business content and generated review text) are owned by Jolly Web Consulting. You may not copy, redistribute, or build a competing product on top of the Service.

You retain ownership of the business name, website content, and logo you submit. You grant us a non-exclusive license to use that content for the limited purpose of operating the Service for you (storing your page, generating reviews from your website snapshot, displaying your business name and logo on your branded page).

Review text generated by the Service is provided to you and your customers free of any restriction by us, subject to the platform rules in Section 6.

9. Third-party platforms

The Service links out to and references third-party platforms (Google, Facebook, Yelp, Nextdoor, Stripe, Anthropic). We do not control those platforms and are not responsible for their content, availability, or actions. Your use of those platforms is subject to their own terms.

10. Disclaimers

The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated text will improve your ratings, ranking, or revenue.

11. Limitation of liability

To the maximum extent permitted by law, Jolly Web Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Jolly Web Consulting from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third party's rights, including any review-platform's rules.

13. Termination

You may stop using the Service at any time by canceling your subscription. We may suspend or terminate your access to the Service at any time for violation of these Terms or to comply with the law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

14. Changes to the Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and email active subscribers at least 14 days before material changes take effect. Continued use of the Service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction.
